Dispute Policy

Effective August 2026 · Applies to all client engagements

Disputes are rare, but when they arise the aim is always a fair, direct resolution between both parties — without the need for third-party escalation or legal proceedings.

Raise it in writing

Email hello@kushanekanayake.me with a clear description of the issue within 14 days of the event.

Good-faith discussion

Both parties commit to a direct, honest conversation to understand and resolve the issue.

Resolution within 7 days

A resolution — revised work, partial refund, or mutual termination — is reached within 7 business days.

01 Raising a Dispute

All disputes must be raised in writing by emailing hello@kushanekanayake.me within 14 days of the event giving rise to the dispute. The written notice should include:

  • A clear description of the issue
  • The relevant project or invoice reference
  • What outcome you are seeking

Verbal or informal complaints alone do not constitute a formally raised dispute.


02 Resolution Process

Both parties agree to first attempt resolution through direct, good-faith communication. No third-party mediators, platforms, or legal proceedings will be invoked unless all direct resolution efforts have been exhausted.

A resolution will be sought within 7 business days of the dispute being formally raised. If the dispute involves delivered work, revisions may be offered as a first step before any financial resolution is considered.


03 Work and Payments During a Dispute

All active work on the project is paused from the moment a dispute is formally raised until it is resolved. Ownership of all work in progress — including designs, code, and assets — remains with Kushan Ekanayake until the dispute is settled and any outstanding payments are resolved.


04 Possible Outcomes

Depending on the nature of the dispute, outcomes may include:

  • Revised or corrected work delivered to the client's satisfaction
  • A partial or full refund in line with the Refund Policy
  • Mutual termination of the engagement with agreed final terms

If no mutually agreeable resolution is reached within the 7-day window, the engagement may be terminated by either party. Any amounts owed for work already completed remain payable.
